Our November 2003 speaker was Gary Kreep, co-founder of the California Justice Political Action Committee (CALJPAC). Gary has been an attorney for 28 years and has served as President of CALJPAC since 1996. CALJPAC is a California political action committee registered with the California FPPC.
Gary spoke about the status of justice and the "rule of law" today in America. He also talked about the Foundation's current projects, specifically the sanctity of life issues with Planned Parenthood.
Gary's opinion is that the constitution is dead and we are at the whim of judges who inflict their own personal agenda's on us, not using the true rule of law. Judges know the average citizen cannot afford the time and expense of appeals, so the judge's findings are frequently accepted, though they may not truly be "legal".
He cited several examples. One example is Judge Reed here in San Diego, who rules consistently in favor of pro-abortion, no matter what the law says. Another example is the current Alabama case where a Ten Commandments statue was removed from a courthouse, and a judge was taken from office for refusing to remove the statue. Gary's research shows that the federal court ordered the state court (and the judge) to do something that the federal court legally had no right to do. This was a state law issue, not a federal law issue. The federal court overstepped its legal boundary.
Currently Gary's organization is in litigation with Planned Parenthood. Planned Parenthood treats kids 5 years and up. They have many kids who have sexually transmitted diseases, but they claim they do not have to report sexual molestation. This protects their staff to satisfy state law related to medical training. The Foundation is appealing a lower court's decision permitting Planned Parenthood to continue this practice. Gary asked for prayer for this appeal.
In the midst of the legal morass, there are opportunities for mercy and effective action. Gary told an inspirational story about a woman named Connie, who regularly picketed abortion clinics, with appropriate respect and love. In one incident, a woman tried to run over Connie multiple times - she was injured very slightly. Connie did not press charges, but asked the court to have mercy on the driver. Connie asked that the driver be required to provide a small donation to a charitable fund for the poor. Mercy triumphed.
The final challenge and caution from Gary is clear - it is important for you to keep informed and be involved. You could be next to be in a similar legal struggle. Stay vigilant and pray for God's victory in the darkness of America's legal system.
